Terms of Service

These terms govern your use of the free Adaptive Capacity Snapshot and The Adaptive Capacity Inventory™ at assessments.adaptivecapacitysystems.com, operated by The Adaptive Capacity Systems LLC ("we"). When you tick the agreement box at an assessment gate and continue, you agree to these terms and to the conditions shown there, and you acknowledge the privacy policy. Using the site also constitutes agreement to these terms. If you do not agree, please do not use the site.
Eligibility
You must be at least 18 years old and legally able to enter a contract to use the services. You may complete an assessment only for yourself.
What the services are
The Snapshot and the Inventory are educational tools for self-reflection and professional development. They use your responses to estimate a zone and provide related guidance about the relationship between the demands on you and the resources you have to meet them. A result is not an objective finding and may not accurately reflect your circumstances. Before starting either assessment, you review and agree to the conditions shown on screen; those conditions are part of these terms.
Not clinical, not for employment decisions
The Snapshot and the Inventory are not clinical or diagnostic instruments. They do not diagnose, treat, or screen for any medical or mental health condition, and they are not a substitute for professional care. Results must not be used to make hiring, promotion, compensation, termination, performance management, or other employment decisions, and you may not require an employee, applicant, contractor, or any other person to complete an assessment or provide a result. The services are not emergency services and are not monitored for urgent requests. If you are in immediate danger, contact local emergency services; in the United States you can call or text 988 for crisis support.
Purchases and refunds
The Inventory is a one-time purchase, not a subscription. One payment buys one personal pass through the Inventory: one set of answers, one result, and the choice to save or discard it. Payments are processed by Stripe; prices are in US dollars and may change for future purchases. All sales are final once your result has been shown, including results you chose to discard, and we do not offer refunds for completed assessments. If we charge you and do not provide access because of a problem on our side, we will restore your access or refund the charge, and we will refund duplicate charges. An unfinished Inventory stays available through its private link for 6 months; after that the attempt expires and its draft answers are deleted as described in our privacy policy. Nothing in this policy limits consumer rights that cannot be waived by law.
Your results and your account
At the end of the Inventory you choose to save your results or discard them. If you choose discard, we show the result once, retain no completed result, and delete the in-progress draft from our active application database; a discarded result cannot be recovered. Saved results are available through a private results link and your account, which uses sign-in links sent to your email address. Anyone with an active results link can view those results, and a link opened outside your signed-in account normally stops working 30 days after the result was saved. You are responsible for keeping access to your email account and your links secure; contact us promptly if you believe either has been compromised. How we handle your data is described in our privacy policy.
Your responses
You keep any rights you have in the information you submit. You give us a limited permission to host, process, display, and transmit that information as needed to provide and secure the service, maintain saved results when you request it, comply with law, and carry out the validation and research uses described in the privacy policy.
Our content and trademarks
We own or license the original question wording, answer choices, zone descriptions, guidance, reports, graphics, software, and other content in the services. Copyright protects the original expression in that content, and contract, trademark, and trade secret rights may also apply. The Adaptive Capacity Inventory™ and The Adaptive Capacity Continuum™ are trademarks of The Adaptive Capacity Systems LLC. You may download, print, and privately share your own generated result for personal reflection or individual professional development, for example with a coach or adviser. That permission does not include question text, answer choices, or scoring information, and it does not include administering an assessment to another person. You may not photograph, screen-record, transcribe, scrape, copy, publish, resell, or distribute the assessment questions, answer choices, scoring information, or standalone guidance. You may not reverse engineer the scoring process, and you may not use assessment content, scoring information, or service outputs to develop, train, fine-tune, evaluate, benchmark, validate, or improve another assessment, dataset, software product, or machine-learning model, without our written permission.
Acceptable use
You may not bypass payment or security controls, use another person's email address without permission, share an Inventory pass, scrape or bulk-access the service, introduce malicious code, or disrupt or test the service without written authorization. These restrictions do not prohibit ordinary browser features or assistive technologies used to access the service for yourself.
Suspension and ending the service
You can stop using the services at any time and can request deletion of your data as described in the privacy policy. We may suspend access immediately when reasonably necessary to protect users, the service, or legal compliance; for other material violations of these terms we will, when practical, give notice and a chance to correct the problem. Suspension does not change the retention periods in the privacy policy. We may change or discontinue features. If we ever plan to end access to saved results, we will give account holders reasonable notice and an opportunity to export their saved results when practical, and if we cannot deliver a purchased but unused Inventory pass, we will provide a replacement or a refund.
Disclaimers and limits
Except for rights that cannot be waived, the services are provided as is. We do not promise that a result will be accurate, complete, or suitable for a particular decision, or that the site will be uninterrupted or error free. To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, and our total liability for direct damages arising from the services will not exceed the greater of the amount you paid for the affected Inventory purchase or $100. These limits do not apply to fraud, willful misconduct, or liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law rules, except that this choice does not remove any nonwaivable rights you have under applicable consumer law. Subject to those rights, disputes must be brought exclusively in the state or federal courts located in Virginia.
Changes
When these terms change, we will post the updated version and date here. For a material change, we will give account holders reasonable advance notice by email or through a prominent notice on the site, and we will ask for new agreement when required by law or when a change materially affects payment obligations, dispute terms, liability limits, research use, or rights in your information. Changes apply prospectively unless applicable law permits otherwise.
General
These terms, the checkout disclosures, and the versioned assessment conditions you accept form the agreement for the services, and the privacy policy explains how we handle personal data. If these documents conflict, the privacy policy controls data handling, the assessment conditions control assessment use, the checkout disclosures control payment, and these terms control other matters. If a court finds part of these terms unenforceable, the remaining parts stay in effect, and the affected part will be limited only as much as necessary. You may not transfer an Inventory pass, your account, or your rights under these terms to another person; we may assign these terms in connection with a merger, financing, reorganization, or sale of all or part of the business, subject to the privacy policy and applicable law. Provisions that by their nature should continue after use ends, including intellectual property, disclaimers, liability limits, and dispute provisions, remain in effect.
